THE TRANSPORTATION OF PASSENGERS BY AIR: A COMPARATIVE ANALYSIS OF CEMAC LAWS AND OTHER INTERNATIONAL CONVENTIONS
Abstract
Air travel has become the primary mode of carrying passengers across great distances. At the same time, the aircraft transports a significant volume of cargo. Several international and regional conventions and legislation have been enacted to control air passenger transportation. How much the method of air carriage, just found as a consequence of scientific invention, is governed by current laws, and how far, if at all, new rules will be applied, is thus a critical question.
One significant recent development in international transport law was the entrance into force on November 4, 2003, of the Convention for the Unification of Certain Rules Relating to International Carriage by Air, also known as the Montreal Convention 1999. The so-called Warsaw Convention, agreed in 1929, established a degree of international uniformity in the regulations governing air transportation. At the regional level, the CEMAC Law governs this kind of transportation. Despite the numerous agreements and laws regulating the carriage of people by air, air passengers confront the risk of bodily injury in the event of an accident, and most of the time they are left uncompensated.
As a result, this study investigates passenger air transportation by conducting a comparative analysis of the CEMAC Laws and other international conventions governing air transport. The researcher uses qualitative research methodology as well as comparative analysis methodologies to compare various laws. The findings show that the law of carriers is ancient and well established. Previously, its theories applied to carriage by air, land, and water. It is recommended that suitable compensation mechanisms be implemented within the sphere of compensation to passengers, particularly for bodily injuries, to ensure that people who suffer from such aviation catastrophes are adequately reimbursed.
