TERMINATION OF CONTRACTS OF EMPLOYMENT AND THE APPLICABILITY OF THE ILO STANDARDS ON UNFAIR DISMISSAL IN CAMEROON
Abstract
The ILO adopted the Termination of Employment Convention No. 158 of 1982 in order to put an end to the idea of “at will” termination, which was common in most nations.
The goal of this Convention was to end the practice of unjust dismissal that was prevalent in most nations.
Regardless of the existence of the aforementioned Convention, the practice of determining employment contracts in Cameroon is employer-friendly, since the employer is free to decide (terminate) his employee’s contract for any reason or no reason at all.
This notion contradicts the ILO Convention No. 158 of 1982, a convention lawfully ratified by Cameroon, which permits for termination for a justifiable cause under Article 4.
Another issue that has exacerbated unjust termination is Cameroon’s inadequate execution of existing regulations governing employment contract termination at both the international and national levels.
Even though there are various organizations in place, such as the Labour Inspectorate, to guarantee that workers are protected against unfair termination, unfair termination has remained a significant issue in the Cameroon economy.
The researcher used a doctrinal approach to study in order to thoroughly analyze the difficulties posed. A random interview with certain significant informants was also undertaken, which assisted the researcher in reaching suitable conclusions and results.
Due to inadequate implementation and the lack of a supervising authority to guarantee that the systems in place to safeguard employees perform their job in giving sufficient protection against unfair termination, it was discovered that unfair dismissal continues to exist in Cameroon.
The findings led to the conclusion that the ILO Convention No. 158’s application in Cameroon had failed.
Thus, in order to provide adequate security to workers, the researcher recommended that the Cameroon labor code be amended to comply with the convention’s provisions, as well as the establishment of a supervisory body to ensure that the powers that be comply with the convention, as this will ensure and increase labor security for workers.
