DECLARATION OF ASSETS BY STATE OFFICIALS AND MISUSE OF PUBLIC FUNDS IN CAMEROON
Abstract
With the ongoing trend or series of arrests of public officials due to the misappropriation of public funds by public officials in Cameroon, Law No. 003/2006 of 25 April 2006 relating to the Declaration of Assets and property which was first stated as a clause in article 66 of the 1996 constitutional amendment, completing the 1972 constitution, has been considered as an accurate measure which can put and end and effectively monitor misappropriation of public funds by state authorities.
The enactment of laws and establishment of institutional mechanisms towards this end are partly a reflection of the attainment of such a mission and can also be the measure by which a commitment can be assessed. The aim of this research is to investigate how the Declaration of Assets and property can contribute to the fight against the Misappropriation of Public funds in Cameroon. In order to achieve the aims of this research, a deductive research technique was used to gather data.
Qualitative research methodology was used and recourse was made of relevant documents from both secondary and primary sources to help with the realisation of this work. Secondary sources such as; books, articles, journals, newspapers, thesis defended by others as well as some internet sources and Primary sources such as; Laws, case laws.
A Doctrinal method was used to analyse legal rules. One of the main reasons public authorities keep misappropriating public funds is because the law of Declaration of Assets and property has not yet been implemented. If it is implemented, it will be a vital method of controlling the wealth accumulation of public authorities.
In order for Assets Declaration to be effective and efficient to fight misappropriation of public funds by state authorities, Asset Declarations should be transparent and a number of expertise should be trained to monitor the wealth of state authorities outside the country. However, it’s application is very necessary but does not guarantee a permanent stop to the misappropriation of public funds by state authorities in Cameroon.
