AN APPRAISAL OF THE ADMINISTRATION’S INTERVENTION IN THE MANAGEMENT OF FOREST RESOURCES IN CAMEROON.
Abstract
This study set to assess the efficiency of the legal regime for the intervention of the administration in the management of forestry resources in Cameroon. Forest resources and it exploitation is necessary for it provides a source of livelihood for people especially the local community, thus it management is necessary.
In spite of the advances in sustainable management of forests, facilitated by the 1994 law and its instruments of application and the increase in forest law enforcement, there are still incidences of illegality in the exploitation of Forest Resources. The methodology adopted in the study is qualitative.
Data was obtained from the primary and secondary sources. Primary data include laws at it emanate from the legislator, case law and interview. Secondary data include textbooks, published and unpublished thesis, peer-reviewed journal articles, the internet sources as well as seminar and conference papers.
Through this methodology, the findings reveal that, the 1994 Forestry Law, put all forest resources under the control of the state by classifying the as communal forest and by nationalizing all naturally growing trees. This is evident as it provides that, forest resources with the exception of local council and private forests, as well as agricultural plantations, fallow land, wooded land adjoining an agricultural farm, pastoral and belong to the state.
To this effect, the law authorizes the adoption and implementation of some regulatory acts which ensure effective management of forest resources. Certain aspects of forest policy and the legal and administrative arsenal that support it need to be revised.
This would involve facilitating policy innovation and the improvement of the forestry law and related administrative instruments in force, in the light of results, assets and shortcomings recorded in and around the field of decentralized management of forests and derived benefits.
