Abstract

The purpose of motor vehicle insurance is to pay victims of car accidents caused by drivers.  However, there are some cases in which the insurance is unable to reimburse the victims.  This could be due to a variety of reasons, including the invalidity of the insurance contract, the suspension of the contract, insolvency, “hit and run” drivers, or if the driver is not covered.  In such cases, there is frequently the issue of who should recompense the victims.  The purpose of this study is to investigate the settlement of motor vehicle insurance claims in Cameroon, with a focus on third-party liability insurance in Buea.

To achieve the goal outlined in this paper, we used both doctrinal and empirical research methods, which entailed analyzing both primary and secondary sources of information.  The study also includes some fieldwork in the form of unstructured interviews with employees from Buea insurance companies.  The findings reveal that the concept of third party is difficult to evade since not everyone is considered a third party, and there are specific requirements that limit the scope of compensation under third party liability insurance.

In addition, there are procedural requirements that must be met in order to get proper compensation.  However, the procedures do not apply to both insured and uninsured vehicles.  Furthermore, there are various obstacles that prevent efficient compensation for victims of motor vehicle accidents; these obstacles allow some victims to go uncompensated or delay the compensation process, rendering it ineffective.  As a result, it is recommended that the law impose harsh penalties for failure to comply with the rules of compulsory motor vehicle insurance, as well as harsh penalties for drivers who escape the scene of an accident after leaving the victim forlorn.
