ASSESSING THE LIABILITY OF ROAD CARRIERS IN CAMEROON: ANALYZING THE IMPLICATIONS OF THE OHADA UNIFORM ACT ON THE CARRIAGE OF GOODS BY ROAD
Abstract
This study examines the liability of road carriers in Cameroon under the OHADA Uniform Act on the Carriage of Goods by Road (UACCGR). It highlights the critical role of transport in economic integration, particularly in sub-Saharan Africa, and the significance of road transport within the OHADA framework.
The study identifies the carrier’s obligations and the presumption of liability, which places a significant burden on road carriers. It explores the various causes of liability, including loss, damage, and delay in delivery, and analyzes how these liabilities are assessed through fault, appearance, and due diligence.
The research further distinguishes between contractual and non-contractual liabilities, shedding light on the complexities faced by carriers. It addresses the limitations and exclusions of liability, emphasizing the importance of understanding both total and special exoneration grounds. The findings indicate that while the UACCGR presumes liability, carriers can be exonerated under specific circumstances.
Recommendations for improving the limits of liability include adopting automated sheeting systems, conducting thorough investigations of carrier conduct, and ensuring contract fairness. This study contributes to the discourse on transport law in Cameroon and offers insights for policymakers and legal practitioners in navigating the challenges of carrier liability.
